Join David Ralston of Foley & Lardner, LLP as he discusses how to comply with the American Recovery and Reinvestment Act’s “Buy American” provisions, including certification requirements, obligations and liability implications.
 
You will learn about the Buy American requirements for construction companies on government contracts to use domestic construction materials, and the new federal procurement regulations implementing the Buy American requirement at the federal level. Also, hear about the Office of Management and Budget guidance and federal agency regulations implementing the requirement at the state and local levels through Recovery Act grant conditions.
 
Additionally, learn about the Buy American certification process that has been imposed on prime contractors of Recovery Act-funded projects, including how to complete the certification to comply with the Buy American provision. Ralston will examine how to approach achieving certification from the prime contractor and supplier contracting tiers.
 
Ralston also will discuss recent amendments to the False Claims Act and how, in light of the Buy American certification requirement, Buy American violations will likely entail False Claims Act exposure.
