ABC is encouraging all members to take action and submit comments to the Department of Labor (DOL) on how its Wage and Hour Division’s Defining and Delimiting the Exemptions for Executive, Administrative, Professional, Outside Sales and Computer Employees proposed rulemaking, commonly referred to as “the overtime proposal,” will harm the construction industry and small businesses.

Under the proposed rulemaking, issued June 30, an increase of over 100 percent to the minimum salary threshold coupled with a modification of the duties test will increase labor costs and devastate the economy.

ABC July 23 filed a letter with the DOL requesting an extension of the comment period on the proposed rulemaking; however, the extension was not granted.

ABC National will be filing comments by the Sept. 4 deadline and members can submit their concerns through the ABC Action Center or through the ABC Action App on either iPhone or Android devices.
