FAQs Available on Summary of Benefits and Coverage Final Rule

The Departments of Labor, Health and Human Services and the Treasury recently issued a list of FAQs related to the Feb. 14 final rule implementing the provision on summary of benefits and coverage in the Patient Protection and Affordable Care Act.

Final Rule Implements Health Insurance Exchanges

On March 12, the U.S. Department of Health and Human Services (HHS) published a final rule on health insurance exchanges, which combines policies from two other proposed rules published last summer.

Reduction in Design Value for Southern Pine Lumber Effective June 1

Beginning on June 1, the design values for certain types of visually graded Southern Pine lumber will be reduced, according to a Jan. 11 decision by the American Lumber Standard Committee. 

Final Regulations Issued on Summary of Benefits and Coverage

On Feb. 14, the Departments of Treasury, Labor and Health and Human Services issued final regulations regarding the summary of benefits and coverage and the uniform glossary for group health plans and health insurance coverage in the group and individual markets. The final regulations are effective April 16, 2012.

USDA Withdraws Procurement Rule Reminiscent of Clinton-Era Blacklisting Policy

The U.S. Department of Agriculture (USDA) has announced it is withdrawing a Dec. 1 direct final rule that would have altered the USDA’s procurement policies to require federal contractors to certify that they, as well as their subcontractors and suppliers, were in compliance with all applicable labor laws. 

House Passes Bill to Prevent NLRB “Ambush Elections” Proposal

The U.S. House of Representatives Nov. 30 passed the Workforce Democracy and Fairness Act (H.R. 3094) by a vote of 235-188. The bill is designed to counteract a proposed rule from the National Labor Relations Board (NLRB) that would shorten the timeframe for union organizing elections and reverse the Board’s recent decision in Specialty Healthcare. 

ABC Joins Coalition in Offering Feedback on Health Care Regulations

ABC, as part of the Employers for Flexibility in Health Care coalition, submitted comments on provisions in the Patient Protection and Affordable Care Act regarding the health insurance premium tax credit; eligibility determinations and exchange standards for employers; and the health coverage affordability safe harbor for employers.

Health Care Law Update: ABC Comments on Exchanges, Summary of Benefits

ABC in October submitted comments on two proposed rulemakings designed to implement provisions in the Patient Protection and Affordable Care Act. The comments were on establishing health care exchanges and qualified plans and summary of benefits and glossary of terms.

NLRB Decisions Effect Union Elections and Bargaining Units

The National Labor Relations Board (NLRB) in August issued two decisions that hurt employees’ rights by inhibiting their ability to petition for a secret-ballot election after an employer recognizes a union as a monopoly bargaining agent and by creating a new standard for a bargaining unit.

HHS Issues Proposed Rule on Exchange Provision in Health Care Law

The Department of Health and Human Services July 15 issued a proposed rule related to the health care exchange provision in the health care law. By Jan. 1, 2014, individuals and small businesses will be able to purchase private health insurance through state-based competitive marketplaces, called Health Insurance Exchanges.
