OFCCP Issues Final Pay Transparency Rule for Federal Contractors

On Sept. 10, the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) issued its final rule
prohibiting federal contractors and subcontractors from terminating or otherwise discriminating against employees who discuss their compensation with co-workers or job applicants. This rule implements the Obama administration’s Equal Pay initiative under Executive Order 13665 and will take effect on Jan. 11, 2016. Read the rest of entry »

ABC Urges Withdrawal of Obama Administration’s Unlawful and Impractical ‘Blacklisting Proposal’

ABC Aug. 26 submitted comments urging the withdrawal of the Federal Acquisition Regulatory (FAR) Council’s Notice of Proposed Rulemaking (NPRM) and the U.S. Department of Labor’s (DOL) Notice of Proposed Guidance (NPG) implementing President Obama’s “Fair Pay and Safe Workplaces” Executive Order 13673, commonly referred to as the blacklisting proposal. Blacklisting Proposal’s Comment Deadline Extended

The Federal Acquisition Regulatory Council and the U.S. Department of Labor issued a second extension for submitting comments on the proposal implementing President Obama’s Fair Pay and Safe Workplaces Executive Order 13673, commonly referred to as the “blacklisting” executive order, by 15 days to Aug. 26. The extension comes as a result of Republican leaders of three congressional committees requesting an extension of the comment period.

Obama Administration Releases ‘Blacklisting’ Proposal

The Federal Acquisition Regulatory (FAR) Council released a proposed rule and the U.S. Department of Labor (DOL) issued proposed guidance May 27, as directed by President Obama’s July 31, 2014, sweeping “blacklisting” Executive Order 13673 targeting the federal contracting community.

Why The President’s Blacklisting Executive Order Won’t Work

Proposed Rule on Compensation Reports for Federal Contractors Draws Concern

ABC submitted comments on Jan. 5 to the Department of Labor’s (DOL) Office of Federal Contract Compliance Programs (OFCCP) expressing their strong opposition to the proposed rule that would require government contractors to report summary data on employee compensation to the DOL. ABC urges the OFCCP to withdraw their proposal.

OFCCP Final Rule Prohibits Discrimination Based on Sexual Orientation and Gender Identity

The DOL’s Office of Federal Contract Compliance Programs (OFCCP) issued a final rule Dec. 9 implementing Executive Order 11246, which prohibits federal contractors from discriminating against lesbian, gay, bisexual, and transgender (LGBT) employees and prohibits discrimination based on gender identity in federal employment.

Obama Administration Urged to Withdraw Blacklisting Executive Order

ABC and 19 other business trade groups, sent a letter on Nov. 6 requesting that President Obama withdraw the “Fair Pay and Safe Workplaces” Executive Order (E.O.). The letter, sent to U.S. Department of Labor (DOL) Secretary Thomas Perez and Assistant to the President and Director of the Domestic Policy Council Cecilia Muñoz, outlines ABC’s concerns that the E.O. dramatically changes the enforcement mechanisms carefully put in place by Congress and needlessly adds uncertainty, subjectivity and onerous and costly new data collection and reporting requirements for federal contractors.
