Information on PPACA, Including a Summary of Employer Coverage Requirements

On Nov. 20, HHS published proposed rules on essential health benefits and determining actuarial value, and on health insurance market reforms. In addition, the IRS, Employee Benefits Security Administration and HHS’ Centers for Medicare and Medicaid Services issued a notice of proposed rulemaking on wellness programs in group health plans.

MeritChoice Offers Free Flexible Spending Account Plan Amendment

For plan years beginning on or after Jan. 1, 2013, the Patient Protection and Affordable Care Act imposes a $2,500 limit on annual salary reduction contributions to health Flexible Spending Accounts (FSAs) offered under cafeteria plans. This is a reduction from the current limit of $5,000. 

Health Care Law Employer Reporting Required On 2012 W-2 Forms

The Patient Protection and Affordable Care Act requires employers that issue more than 250 W-2 forms to report the cost of health care coverage under an employer-sponsored group health plan on each employee’s 2012 W-2 form, which generally are required to be provided to employees in January 2013.  

Coalition Submits Letter On Implementation Of The Health Care Law

As part of the Employers for Flexibility in Health Care (EFHC) coalition, ABC Sept. 27 submitted comments regarding implementation of the Patient Protection and Affordable Care Act (PPACA) – specifically, on determining full-time employee status and the application of the 90-day waiting period limitation. The comment letter was submitted in response to notices issued by the Departments of Labor, Health and Human Services, and the Internal Revenue Service (IRS).

ABC Offers Feedback on D.C.'s Health Insurance Exchange Proposal

Under the Patient Protection and Affordable Care Act, states will be required to operate health insurance exchanges – marketplaces where individuals and small businesses can purchase private health insurance – beginning in 2014. Over the last several months, ABC has provided suggestions on how the exchanges can best be implemented.

Temporary Guidance Issued On Provisions In Health Care Law

The Departments of Labor (DOL), Health and Human Services (HHS) and Treasury on Aug. 31 issued temporary guidance that addresses the 90-day waiting period limitation contained in the Patient Protection and Affordable Care Act (PPACA).

After the U.S. House of Representatives passed the Repeal of Obamacare Act (H.R. 6079) on July 11, ABC offered practical, common-sense health care solutions and continued to advocate for full repeal of the health care law.  

Guidance Issued on Health Insurance Exchanges and Summary of Benefits

The Department of Health and Human Services on May 16 issued new guidance for states on health insurance exchanges. In addition, HHS in conjunction with the Departments of Labor and Treasury, released an additional set of frequently asked questions regarding implementation of the summary of benefits and coverage provisions included in the health care law.

Notices Issuces Requesting Comments On Health Care Law

The Department of Treasury and the Internal Revenue Service (IRS) recently issued three notices related to the health care law that address minimum value and information reporting on health insurance coverage. In addition, the Departments of Health and Human Services, Labor and the Treasury issued a separate bulletin regarding verification of access to employer-sponsored coverage.  

ABC Comments On Employer FAQs Regarding Health Care Law

As part of the Employers for Flexibility in Health Care (EFHC) coalition, ABC submitted comments April 5 to the U.S. Department of Labor on the Patient Protection and Affordable Care Act (PPACA) to offer its suggestions on ensuring employer-sponsored coverage remains a competitive option for all employees, whether full time, part time, temporary or seasonal.
