This ABC members-only webinar for contractors who build clean energy projects will provide insights into new government-registered apprenticeship and Davis-Bacon Act prevailing wage mandates in the budget reconciliation package.

Problematic language in Subtitle D-Energy Security of the IRA generally slashes longstanding and current tax credits from 30% to a baseline credit of 6% for the private development of solar, wind, hydrogen, carbon sequestration, EV charging stations and other clean energy projects. However, the IRA gives developers a bonus tax credit that is 500% higher than the baseline credit if they require project contractors to pay construction workers union-scale, government-determined hourly wages and benefits and use apprentices enrolled in government-registered apprenticeship programs. In most cases, both conditions must be met to qualify for the bonus rate.

Baskin and Brubeck will address how these provisions present new challenges and opportunities for ABC members and clean energy developer stakeholders.

Maury Baskin serves as ABC’s general counsel and is a shareholder in the Washington, D.C., office of Littler Mendelson P.C., where he co-chairs Littler’s Workplace Policy Institute. He is one of the chief legal advocates for the rights of employers on labor issues throughout the country. Baskin has represented ABC and its member firms at every level of court, up to and including the U.S. Supreme Court.

Ben Brubeck is ABC’s vice president of regulatory, labor and state affairs. In this role, he works with his team work to shape policy on local, state and federal issues important to the construction industry, and represents ABC before lawmakers, the media, construction industry executives and stakeholders. His expertise across a portfolio of issues includes labor and employment, workforce development, infrastructure, federal contractor regulations, small businesses and public works procurement.
