Bill Introduced to Require Statistical Calculation of Davis-Bacon Wages

Rep. Paul Gosar (R-Ariz.) Feb. 1 introduced the Responsibility in Federal Contracting Act (H.R. 448), which would require prevailing wage rates to be scientifically determined by the Department of Labor’s Bureau of Labor Statistics.

ABC Asks Congress to Restrain NLRB After Court Negates Recess Appointments

On Feb. 13, a U.S House of Representatives subcommittee held a hearing on the future of the NLRB following the Jan. 25 decision by an appeals court that President Obama’s recess appointment of members to the board in early 2012 was unconstitutional. The challenge was brought by the ABC-led Coalition for a Democratic Workplace and the ruling invalidates decisions unlawfully made over the past year because the board did not have a quorum.

USACE Issues PLA Survey for New Mexico Project

The U.S. Army Corps of Engineers (USACE) is soliciting comments from the construction industry on the potential use of a government-mandated project labor agreement (PLA) for a project at the New Mexico Cannon Air Force Base.

Building Owners Encouraged to Fill Out Lead-Paint Survey

The EPA is considering federal rules that may regulate renovation and remodeling activities in public and commercial buildings to address possible lead-based paint hazards.  These rules, if enacted, could be based on current lead paint regulations addressing renovation activities in pre-1978 “target housing.” Any such proposal would have a significant impact on commercial and federal contractors.

Ambush Elections Rule Could be Negated by NLRB Recess Appointment Decision

The ABC-led Coalition for a Democratic Workplace Jan. 31 filed a request with the U.S. Court of Appeals as part of their continuing efforts to block the NLRB “ambush” elections rule. The statement of supplemental authorities was filed after an appeals court ruled Jan. 25 that President Obama violated the Constitution when he bypassed the Senate to fill NLRB vacancies.

ABC Feb. 6 launched the first-of-its-kind ABC Action app that enables users to become a vital part of ABC’s grassroots advocacy efforts and further the merit shop philosophy. The app is available for download on iPhone, iPad and Android devices.

ABC Defends Michigan’s Fair and Open Competition Law

ABC National joined ABC of Michigan as they filed an amicus brief Jan. 24 urging the U.S. Court of Appeals for the 6th Circuit to uphold Michigan’s Fair and Open Competition Act in response to a challenge filed by construction unions. The act ensures nondiscriminatory procurement of state services in public construction.

Bill Would Guarantee Open Competition on Federal Construction

ABC Jan. 30 offered strong support for the Government Neutrality in Contracting Act (H.R. 436/S. 109), a measure introduced by Rep. Andy Harris (R-Md.) and Sen. David Vitter (R-La.) that would ensure fair and open competition on federal and federally funded construction projects.
