ABC Slams U.S. DOL’s Withdrawal of Trump-era Independent Contractor Final Rule

May 05, 2021

On May 5, the U.S. Department of Labor announced the withdrawal—effective May 6—of the Trump-era independent contractor final rule. While expected, this action is extremely disappointing. ABC strongly supported the Trump DOL final rule, which would have clarified the department’s interpretation of independent contractor status under the Fair Labor Standards Act and promoted certainty for employers, independent contractors and employees.

Funding Resolution Signed That Includes DOL Restrictions On H-2B And MSD Rules

President Obama Sept. 28 signed into law a continuing appropriation resolution (H.J. Res. 117) that will fund the Department of Labor (DOL), National Labor Relations Board (NLRB) and the Equal Opportunity Commission for the first six months of fiscal year 2013, but that also includes restrictions on actions by DOL. As part of the Employers for Flexibility in Health Care (EFHC) coalition, ABC Sept. 27 submitted comments regarding implementation of the Patient Protection and Affordable Care Act (PPACA) – specifically, on determining full-time employee status and the application of the 90-day waiting period limitation. OSHA Adds Four New OTI Centers And Renews 24 Existing Centers

The Occupational Safety and Health Administration (OSHA) Sept. 28 announced it added four new OSHA Training Institute (OTI) Education Centers in addition to renewing 24 existing centers.
