Proposed Worker Classification Survey Causes Concerns for ABC

ABC March 12 submitted comments in response to a Department of Labor information request regarding a proposed worker classification survey.  According to DOL, the proposed survey would “collect information about employment experiences and workers’ knowledge of basic employment laws and rules so as to better understand employees’ experience with worker misclassification.”

OFCCP Rescinds Guidance Documents on Compensation Procedures

OFCCP Directive Addresses Hiring Policies Related to Criminal Records

The Office of Federal Contract Compliance Jan. 29 issued a directive, effective immediately, offering information to federal contractors and subcontractors on complying with nondiscrimination provisions, particularly related to criminal record restrictions and discrimination based on race and national origin.

DOL Agenda Lists Imminent Actions on Persuader, OFCCP Affirmative Action Rules

The Department of Labor on Dec. 21, 2012, released an updated agenda outlining the regulatory activities of its sub-agencies for the next year. The agenda includes items on reporting requirements for labor consultants, employers and associations, and affirmative action in federal construction, among other issues.

OFCCP Hiring Quota Proposal Sets Unachievable Standards, Group Tells Solis

ABC, along with nine other groups, May 23 sent a letter to the Department of Labor (DOL) Secretary Hilda Solis raising concerns about a recent Office of Federal Contract Compliance Programs (OFCCP) proposed rulemaking that would set hiring quotas for federal contractors to employ workers with disabilities.

EEOC Issues Updated Guidance on the Use of Criminal Background Checks

The U.S. Equal Employment Opportunity Commission on April 25 issued an updated Enforcement Guidance document that addresses the use of arrest and conviction records in employment decisions under Title VII of the Civil Rights Act of 1964. According to the EEOC chairwoman, “the new document clarifies and updates the longstanding policy concerning the use of arrest and conviction records in employment.”

ABC Asks Agency To Withdraw Rule Establishing Hiring Quotas

In an April 17 letter to a U.S. House of Representatives subcommittee in response to its hearing, “Reviewing the Impact of the Office of Federal Contract Compliance Programs' (OFCCP) Regulatory and Enforcement Actions,” ABC reacted to a recent OFCCP proposed rulemaking that would set hiring quotas for federal contractors to employ workers with disabilities, in addition to requiring greatly increased recordkeeping and affirmative action steps.

ABC Critical Of OFCCP Proposal On Hiring Of Disabled Workers

ABC on Feb. 21 filed comments with the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) in response to a proposed rule that would set a national hiring goal for federal contractors to employ workers with disabilities, in addition to requiring greatly increased recordkeeping and affirmative action steps. Under the proposal, OFCCP would mandate federal contractors to set a goal of having persons with disabilities comprise at least 7 percent of their workforces. OFCCP is also considering an additional goal of having at least 2 percent of federal contractors’ employees comprised of persons with “certain particularly severe” disabilities.
