ABC Delaware President Ed Capodanno was recognized with a tribute thanking him for his “long and illustrious leadership at both Associated Builders and Contractors, Delaware Chapter, and a wide range of community service work in the First State,” signed by every Delaware state lawmaker, Republican and Democrat.

With essentially all House races called, Republicans are on pace to hold the House majority by approximately the same margin that Democrats enjoyed in the 117th Congress—around five seats. On the heels of Democrat John Fetterman’s defeat of Dr. Mehmet Oz, Republican, to flip retiring Republican Sen. Pat Toomey’s seat in Pennsylvania, Democrats will return to the Senate majority.

On Sept. 19, California Gov. Gavin Newsom signed Assembly Bill 2188 into law, enacting restrictions effective Jan. 1, 2024, on employers’ use of cannabis metabolite testing to penalize existing employees and candidates for employment. AB 2188 lends definition to an emerging nationwide landscape of adjustments in state employment regulation to increasingly permissive medical and recreational cannabis laws.

The ABC Keystone, Eastern Pennsylvania, Western Pennsylvania and Cumberland Valley chapters recently signed a statewide letter of agreement with the Pennsylvania Department of Corrections to help formerly incarcerated citizens kickstart a career in construction.

On June 14, the ABC Keystone Chapter welcomed 12 girls from surrounding school districts to its facility to learn about blueprints, the construction process and safety at a week-long summer program called the All ‘Bout Construction (ABC) Girls Camp. The first of its kind at the chapter, the camp allowed girls to meet women who work in the industry and visit a series of jobsites. They even got a chance to build and take home their own multi-trade, steampunk-themed lighted charging station using their own set of tools from Klein and ABC strategic partner Milwaukee Tool.

On June 4, Florida Gov. Ron DeSantis addressed ABC chapters and members at ABC Legislative Day 2021 in Ponte Vedra Beach, Florida. The governor was introduced by Tim Keating, ABC’s immediate past chair of the board.

The Biden administration and U.S. Department of Treasury have taken another unfortunate step promoting controversial, anti-competitive and costly government-mandated project labor agreements, local hire and Davis-Bacon/prevailing wage policies on federally assisted taxpayer-funded construction projects.

On March 16, the Michigan State Senate passed  Senate Concurrent Resolution 8, which opposes the Protecting the Right to Organize (PRO) Act, federal legislation that would strengthen union organizing rights and restrict the autonomy of workers and employers.

ABC of California applauded the California State Assembly for the unanimous and bipartisan passage of Assembly Concurrent Resolution 23, which proclaims March 18, 2021 as Construction Suicide Prevention Awareness Day in California—raising awareness of an important health problem affecting the state’s construction industry. ABC of California supports ACR 23 and is currently working alongside its author, Assembly member Carlos Villapudua (D-Stockton), to help change the conversation around suicide and suicide prevention.

The Unionstats.com website was recently updated with the latest state-specific union membership data based on the January release of the U.S. Bureau of Statistics’ 2020 nationwide data on unionization rates.

While a handful of U.S. Senate, House and state legislative races from the 2020 elections remain uncalled, voters in a handful of states made some significant policy changes on Tuesday, Nov. 3, through the ballot initiative and referendum processes. Many of these affect the construction industry, including changing the minimum wage, legalizing and decriminalizing marijuana, paid family and medical leave and more.  

The big story of the night is that we do not have a winner in the presidential election yet with Georgia, Michigan, Nevada, North Carolina, and Pennsylvania and too close or too early to call at this time, while projected contests in Wisconsin and Arizona seem to favor Vice President Joe Biden, which would give him a 248-214 lead in the race towards the 270 Electoral College votes needed to win the presidency.

On Oct. 27, Maryland Gov. Larry Hogan attended the grand opening of ABC Greater Baltimore Chapter’s new Construction Education Academy, located at a Project C.O.R.E site in East Baltimore. This new state-of-the-art facility will house the largest concentration of building trade apprenticeship programs in the state, enabling ABC Greater Baltimore to train up to 5,000 skilled workers each year, doubling their current capacity.

The ABC Pelican Chapter recently held a fundraiser to help staff affected by Hurricanes Laura and Delta. Through the sales of “Louisiana Strong” shirts and cash donations from members, families and other nearby ABC chapters, the ABC Pelican chapter raised nearly $10,000.

On Sept. 22, Bernalillo County’s board of commissioners passed an ordinance requiring a community workforce agreement, also known as a project labor agreement, on all construction projects performed for the county that are valued at more than $7 million. The threshold was originally set at $5 million, but was raised to $7 million after a 30-day comment period following the introduction of the ordinance in August.

Virginia has promulgated an Emergency Temporary Standard for COVID-19 that applies to all employers performing work in the commonwealth. The rule took effect July 27, and employers are required to train workers under these requirements by Aug. 26 and have a response plan by Sept. 25.

As many as 31 states and the District of Columbia now mandate the use of facial coverings in public in some form as new infections have surged across the United States in recent weeks. Some states, such as North Carolina and New Jersey, specifically mention the construction industry in their executive orders and require compliance with the order both by workers and jobsite visitors.

On July 15, Virginia became the first state in the nation to enact an Emergency Temporary Standard to address the COVID-19 pandemic. The ETS will go into effect at the end of July.
