ABC Slams U.S. DOL’s Withdrawal of Trump-era Independent Contractor Final Rule

May 05, 2021

On May 5, the U.S. Department of Labor announced the withdrawal—effective May 6—of the Trump-era independent contractor final rule. While expected, this action is extremely disappointing. ABC strongly supported the Trump DOL final rule, which would have clarified the department’s interpretation of independent contractor status under the Fair Labor Standards Act and promoted certainty for employers, independent contractors and employees.

EPA Update: The Latest on WOTUS and the Clean Power Plan

On Feb. 6, the Environmental Protection Agency and U.S. Army Corps of Engineers published a final rule adding an applicability date of Feb. 6, 2020 to the 2015 rule defining “waters of the United States” (WOTUS). Demand for Construction Workers Remains Strong

The unemployment report from the Bureau of Labor Statistics shows growth in both public and private construction spending, according to an analysis by ABC. Construction added 36,000 net new jobs in January, an impressive increase of 0.5 percent on a month-over-month basis.   READ MORE

Nonresidential Construction Maintains Momentum in December

Nonresidential construction spending expanded 0.8 percent in December, totaling $720.4 billion on a seasonally adjusted basis, according to ABC's analysis of data released by the U.S. Census Bureau. This represents the fifth consecutive month during which the pace of nonresidential spending has increased.  READ MORE
