An Idaho appeals court May 22 sent a lawsuit related to project labor agreements (PLAs) and job targeting back to a district court in order to allow the union groups who filed the lawsuit to add defendants and to give both sides a chance to revise arguments.

ABC celebrated another victory in the fight against government-mandated PLAs after the DOL awarded ABC New Hampshire/Vermont Chapter member Eckman Construction Company a $31.6 million contract to build a DOL Job Corps Center in Manchester, N.H., after removing a controversial PLA mandate from the federal project’s solicitation for construction services. Eckman Construction Company, Bedford N.H., submitted a bid that was more than $6 million below the lowest offer when the project was subjected to a PLA.

On April 8, North Dakota Gov. Jack Dalrymple signed into law H.B. 1270, which will ban government-mandated PLAs on state and local construction projects in the state. A week later, New Jersey Gov. Chris Christie vetoed legislation (S. 2425) that would have expanded the ability of public entities in the state to mandate PLAs on taxpayer-funded contracts to rebuild New Jersey after Hurricane Sandy.

ABC and a diverse group of 15 construction industry associations April 16 sent a letter to members of the U.S. House of Representatives and the U.S. Senate opposing government-mandated PLAs and asking them to cosponsor the Government Neutrality in Contracting Act (H.R. 436/S. 109).
