The Obama Administration’s regulatory agenda was released on Nov. 20 and lists the priorities of the administration and the rulemakings they expect to release in 2016, their final year. An update on rulemakings from a variety of agencies affecting the construction industry is below. ABC has also published Newsline stories updating the status of rulemakings from theOccupational Safety and Health Administration (OSHA) and the U.S. Department of Labor listed in the regulatory agenda. On Dec. 4, President Obama signed the Fixing America’s Surface Transportation Act (H.R. 22) into law, which included ABC-supported provisions that streamline the process for developers trying to obtain environmental permits and approvals for their projects.
On Sept. 14, ABC, along with a coalition of nearly 400 business groups sent a letter to U.S. Senate Committee on Homeland Security and Governmental Affairs Chairman Sen. Ron Johnson (R-Wis.) and Ranking Member Sen. Tom Carper (D-Del.) urging them to support the Regulatory Accountability Act of 2015 (S. 2006).
The U.S. House of Representatives passed the ABC-supported Regulations from the Executive in Need of Scrutiny (REINS) Act of 2015 (H.R. 427) July 28. The bill was sponsored by Rep. Todd Young (R-Ind.) and was cosponsored by an additional 171 representatives.

The U.S. House of Representatives recently passed two ABC-supported regulatory reform bills with bipartisan support. The Achieving Less Excess in Regulation and Requiring Transparency (ALERRT) Act (H.R. 2804) passed the House on Feb. 27 by a vote of 236-179 and the Responsibly and Professionally Invigorating Development” (RAPID) Act (H.R. 2641) passed the House on March 6 by a vote of 229-179.

On July 12, the Federal Motor Carrier Safety Administration issued revised guidance under the hours of service (HOS) rules for how commercial drivers should record and take breaks.
The Federal Motor Carrier Safety Administration’s changes to the drivers’ Hours of Service rule, which changes the total hours a week a truck driver can work from 82 to 70 and implements a “34 hour restart” requirement, goes into effect July 1. The rule also requires a driver to take a 30-minute break for every eight hours of consecutive driving.
The Department of Labor Office of Labor-Management Standards Aug. 3 published a proposed rule for the implementation of Executive Order 13496 that requires federal contractors and subcontractors to post a notice aimed at informing employees of their rights to join or not join a union.
ABC Vice President of Federal Affairs Geoff Burr April 10 testified before the U.S. House of Representatives Appropriations Labor, Health and Human Services subcommittee during a hearing, “Regulatory Approaches to Foster Economic Growth.” In his testimony, Burr spoke on behalf of ABC and the ABC-led Coalition for a Democratic Workplace (CDW) about burdensome regulations and policies.
